Is your GP practice lease due to expire? You can instigate the process 12 months prior to the expiry of the lease!

Once a lease expires a tenant and landlord will have to go through a lease renewal process. If an owner-occupied surgery is sold to an investor, then a new lease should be put in place or maybe an owning GP Partner decides to retire then the same would apply, and again a new lease should also be put in place.

This makes sure that both parties know exactly what is occupied, for how long, and who is responsible to do what under the Lease.

The process for setting up a new lease renewal comprises of:

  1. Draft heads of terms – which set out the main headline clauses including, what is being leased (Property), initial Rent, length of lease, who is responsible for the repair and maintenance of the premises and the rent review basis (market rent or RPI) and frequency.
  2. Negotiate and agree heads of terms between Landlord and Tennant and their respective representation.
  3. Seek approval from the NHS for the agreed Heads of Terms.
  4. Liaise with solicitors to ensure the new lease is signed.

Please note: New lease renewals should ideally be instigated 12 months prior to the end date of the original lease.

  • Liaise with solicitors, the Landlord/other party and the NHS (if appropriate) to ensure the new lease is signed, agreed, and approved.
